What is the legal concept?<\/h2>\r\n\r\n\r\n\r\n

The goal of legal design is to find an innovative way to explain\u00a0the law in\u00a0order to make it more interesting, easier to understand and more accessible.\u00a0Legal design, as the name suggests, involves the application of\u00a0design thinking: it combines experience in the legal field with an approach from the design profession, using\u00a0graphic representation,\u00a0clear\u00a0language\u00a0and simple\u00a0and\u00a0new technologies.<\/p>\r\n\r\n\r\n\r\n

The need for legal design stems from a problem that is both extremely old and very relevant today: how to craft\u00a0easy-to-understand\u00a0laws and regulations\u00a0so that people are better able to\u00a0protect\u00a0their interests. Legal conception also means making the law more\u00a0user-friendly.\u00a0The\u00a0users\u00a0of the legal system may be citizens in search of a lawyer, or people who need legal advice when drafting a contract, or even\u00a0lawyers themselves, who want to adopt best legal solution to offer to their clients.\u00a0Legal design helps build\u00a0empathy with users, who thus feel better placed to understand how to achieve their goals.<\/p>\r\n\r\n\r\n\r\n

Take\u00a0contracts, for example.\u00a0As they are usually very long, detailed and difficult to understand, instead of bothering to read them, we often go directly to the final signature (a typical example is the website\u00a0terms\u00a0and\u00a0conditions).\u00a0This happens because contracts are written by legal experts to be read by other legal experts.\u00a0Rethinking a contract from the point of view of the actual user (i.e. the person who has rights and responsibilities flowing from the contract itself) gives new ideas on how to structure its content.\u00a0Using legal design in this context may mean\u00a0simplifying\u00a0the\u00a0language. remove jargon, include tables of contents and add\u00a0graphical representations\u00a0of certain information through diagrams, icons, calendars and pictures.\u00a0This helps to engage users, improves clarity of information and generally facilitates\u00a0understanding.<\/p>\r\n\r\n\r\n\r\n

Why do we need a legal conception?<\/h2>\r\n\r\n\r\n\r\n

  1. It makes customers more satisfied.\u00a0–<\/em>\u00a0Putting yourself\u00a0in your customers’ shoes, understanding their needs and offering them something understandable and valuable tends to be highly valued by customers.\u00a0By listening to customers and working together to create accessible solutions tailored to their needs, you increase their confidence in your business.<\/li>\r\n
  2. It improves understanding and compliance with the law<\/em>\u00a0–<\/em>\u00a0If users are offered a simpler and more interesting legal product (such as a contract), they will feel more\u00a0secure\u00a0in their rights and responsibilities and will be able to understand and to respect the agreements they conclude.\u00a0On a large scale, this can lead to\u00a0better compliance with contract terms and less litigation.\u00a0It also potentially allows the creation of a legal system in which citizens play a more active role.<\/li>\r\n
  3. It encourages innovation and value creation<\/em>\u00a0– Many professionals (and even non-professionals) have good ideas and suggestions to make, but often lack the\u00a0technical skills\u00a0to express them.\u00a0Legal design provides a\u00a0platform\u00a0for these people, paving the way for opportunities and improvements.\u00a0This new system could be used to\u00a0expand\u00a0existing services.<\/li>\r\n<\/ol>\r\n\r\n\r\n\r\n

    Legal design is a useful resource.\u00a0Today, in addition to considering and implementing legal design, companies are increasingly exploring a \u201chuman-centered design\u201d approach, for three reasons:<\/p>\r\n\r\n\r\n\r\n

      \r\n
    1. People are tired of\u00a0complex\u00a0legal documents.\u00a0Human-centered design is now the norm in all major companies (like Apple, Google and IKEA), which provide us with flawless products and services.\u00a0People quickly get used to a “simplified” business relationship, and now we hope that this approach will be extended to all areas where there are\u00a0relationships governed by law.<\/li>\r\n
    2. Users are\u00a0more and more demanding\u00a0on what they expect from their lawyers and notaries, while wanting to pay\u00a0less.\u00a0This means that legal experts must evolve to offer services that meet specific client requirements.\u00a0The legal design helps\u00a0to highlight\u00a0the points that are really important to clients.<\/li>\r\n
    3. The legislation itself\u00a0begins to require legal design.\u00a0For example,\u00a0the General Data Protection Regulation 2016 (GDPR)\u00a0states that all privacy policies should be concise, transparent, and written in plain language.<\/li>\r\n<\/ol>\r\n\r\n\r\n\r\n

      What does the legal conception consist of?<\/h2>\r\n\r\n\r\n\r\n

      The legal design uses a variety of\u00a0tools and methods.<\/p>\r\n\r\n\r\n\r\n

        \r\n
      1. Divergent thinking\u00a0and\u00a0convergent thinking.\u00a0This process takes place in two stages: the first (divergent thinking) is to come up\u00a0with many ideas\u00a0from a single concept or a single piece of information.\u00a0In the second phase (convergent thinking), a unique solution\u00a0is then generated by combining a lot of data and information.\u00a0In any legal design project, it is important to take advantage of both stages to grasp the essence of the problems to be overcome before solving them with ideas and solutions.<\/li>\r\n
      2. Empathy\u00a0and\u00a0understanding\u00a0of the problem.\u00a0Users should always be the center of the design.\u00a0Empathy is used to put yourself in the shoes of the users and understand the problem from their point of view.\u00a0Achieving the optimal solution requires a thorough understanding of the problem, which can be achieved by analyzing every aspect of the user experience.<\/li>\r\n
      3. A\u00a0varied team.\u00a0Having a team of people with a\u00a0variety\u00a0of\u00a0skills is essential to\u00a0ensure that the best possible solution is developed.\u00a0In general, you need highly specialized people (in areas such as IT, psychology, law and design), as well as professionals who can represent users.<\/li>\r\n
      4. Graphic representation.\u00a0The way information is presented influences the way it is received and assimilated.\u00a0In legal design, the presentation of information is an essential part of the\u00a0process\u00a0and the\u00a0solution: the process involves sketches, drawings, sketches and case studies, while the solution can feature diagrams, icons. And images (choosing the language that best suits each specific project).<\/li>\r\n

        What does the legal concept look like?<\/h2>\r\n\r\n\r\n\r\n

        Let’s take a look at some examples of legal design that use different techniques.<\/p>\r\n\r\n\r\n\r\n

        Case Study # 1 – BD Contracts<\/h2>\r\n\r\n\r\n\r\n

        Robert de Roy, the founder of Creative<\/a> Contracts, has created an innovative way to write employment contracts using\u00a0cartoons.<\/p>\r\n\r\n\r\n\r\n

        The idea came from\u00a0seasonal\u00a0agricultural\u00a0workers;\u00a0as these people usually don’t have a lot of reading experience, a long and detailed written contract was not a good solution.\u00a0Workers often signed their contracts without understanding the terms and conditions. The solution was to create a \u201ccartoon contract\u201d that outlined the rights, duties and tasks of employees in their work.\u00a0Design, an almost universal language, has proven to be very effective, and the company has now drawn up twelve different contracts with more than 2,500 signatories.<\/p>\r\n\r\n\r\n\r\n

        Case Study # 2 – Privacy Policies<\/h2>\r\n\r\n\r\n\r\n

        Following the introduction of the new\u00a0GDPR\u00a0rules, many companies have updated their\u00a0privacy policies.\u00a0Logistics software company\u00a0Juror, was no exception and decided to create a user-centric document.<\/p>\r\n\r\n\r\n\r\n

        The challenge was to create a policy that was both\u00a0solid and serious, while being easily\u00a0understood\u00a0by all.\u00a0Juror created a simple and straightforward interactive document that included different sections and levels, icons and deadlines. This helped increase\u00a0the satisfaction\u00a0of the company’s customers as they found the policy really easy to understand as well as to\u00a0advertise\u00a0the company which helped attract new customers.<\/p>\r\n\r\n\r\n\r\n

        Case study 3 – Review and classification of real estate contracts<\/h2>\r\n\r\n\r\n\r\n

        One of the most demanding jobs for any\u00a0real estate agent’s\u00a0legal team\u00a0is renewing\u00a0leases\u00a0and preparing relevant documents for clients.\u00a0In many cases, contracts are analyzed and updated manually, a process that takes several hours.<\/p>\r\n\r\n\r\n\r\n

        Wavelength\u00a0worked with a real estate agent in London to improve their contract renewal process and created a \u201cwork package\u201d divided into two models.\u00a0The first (Marked up Lease) is the renewal contract itself, the\u00a0relevant parts of which\u00a0are automatically highlighted.\u00a0The second (Draft Lease Report) contains the highlighted parts, organized\u00a0in a table in Word.\u00a0This allows lawyers to process only the second document, which speeds up the process.\u00a0And because the end product is summarized in tabular form, it’s also easier to\u00a0navigate…<\/p>\r\n\r\n\r\n\r\n

        The ultimate goal of legal design is therefore to improve\u00a0legal practices\u00a0and the\u00a0processes\u00a0used to draft laws and contracts.\u00a0Additionally, as a user-centric discipline, it seeks to improve\u00a0the experience\u00a0for all who come into contact with legal products and content.\u00a0The legal conception is important because, if the method continues to be adopted more and more widely, it will help to improve the\u00a0understanding\u00a0of the rights and responsibilities of individuals.<\/p>\r\n","protected":false},"excerpt":{"rendered":"
